Clauses applicable to all buyers
  1. Unless otherwise expressly agreed by both parties, only the general and specific terms and conditions attached to this quote, purchase order, delivery note or invoice shall apply.
  2. Any order is invoiced in accordance with the stated rates. Invoices are payable within fifteen (15) calendar days from the invoice date unless otherwise stipulated on the invoice.
  3. Any claim or complaint by the buyer about the goods and services supplied by the seller must be made in writing (by email or by post) within eight (8) days from receipt of invoice date. Any claim or complaint not made by this deadline shall be considered null and void.
  4. In the event of unjustified non-payment of an invoice by its due date, a fixed sum of 15 % of the invoice amount, subject to a minimum of forty euros, shall be payable to Explore.Brussels non-profit organisation by way of damages, without prior formal notice.
  5. Failure to pay an invoice by the due date shall make all sums owed immediately payable, regardless of any payment facilities previously granted.
  6. The customer acknowledges, in accordance with Article 1583 of the Civil Code, that the supplies remain our property until full payment has been made, including any interest and costs. However, the risk is borne by the purchaser as from delivery. Eight days after the dispatch by registered letter of a formal notice to pay which has remained without effect, the goods must be returned to us immediately, at the customer's expense and risk, which the customer undertakes to do, upon our simple request.
  7. These terms and conditions are governed by Belgian law and any potential dispute shall be within the exclusive jurisdiction of the courts of Brussels. However, the seller may waive this jurisdiction clause and, if they prefer, bring an action before the court having jurisdiction under common law.
  8. Given the exceptional and temporary nature of the visits and events organised by Explore.Brussels and given that it is not the owner of the premises, Explore.Brussels undertakes to organise what has been contractually agreed within the bounds of reasonable possibility, but cannot be held responsible in the event of cancellation by the owner of the premises, a late ban on entering the premises, or the cancellation of the visit or event due to force majeure.

Clauses applicable to professional buyers
  1. The customer acknowledges having been properly informed of the quality, instructions for use and any specific properties of the purchased goods and, barring any contrary written clause accepted by both parties, acknowledges that these goods are not intended for any special use.
  2. Any lack of conformity in the supply of goods reported by the customer no later than two weeks after receipt and notified by registered letter shall, at our discretion, give rise to the repair of the defective item or its replacement. If repair or replacement proves impossible or disproportionate, we shall offer an appropriate price reduction or replacement with a conforming item.
Clauses applicable to consumer buyers

Clauses applicable to buyers of guided tours
  1. The customer agrees to abide by the rules of the venue visited; any damage may lead to a claim for compensation.
  2. The consumer does not have the right to cancel the purchase.
  3. The reservation is only valid for the date and time indicated. Only bookings made via Explore.Brussels ASBL are valid. Any falsification of the reservation will lead to legal action.
  4. The holder of a reservation, as well as any persons accompanying them, attend the event or journey to which this reservation gives access under their own responsibility and waive any recourse against Explore.Brussels ASBL. Under no circumstances can Explore.Brussels ASBL be held liable for any material or physical damage caused to third parties. The same applies to any theft or loss that may occur before or during the event for which the ticket is issued.
  5. The booking may not be used for advertising and/or commercial purposes without the permission of the organisers of Explore.Brussels ASBL. Personal information collected by Explore.Brussels ASBL at the time of the sale of this ticket may not subsequently be used for advertising or commercial purposes by third parties. Any request to consult, modify or delete this information must be sent in writing (email or post) to Explore.Brussels ASBL.
  6. Absence of right of withdrawal: although Article 47 of the law on market practices and consumer protection provides for any distance contract that the consumer has a period of 14 days to cancel the contract, this right of withdrawal does not apply to contracts concluded via the website. Pursuant to the Royal Decree of 18 November 2002, certain distance contracts for the provision of accommodation, transport, catering and leisure services are excluded under certain conditions from this possibility. This exception for the tourism sector is dictated by the specific nature of the services provided in this sector and complies with European regulations concerning distance selling, which also provides for an exception for accommodation, transport, catering and leisure services.
  7. The booking cannot be refunded even in the event of loss or theft, nor taken back, nor exchanged, nor modified except in the event of cancellation by’Explore.Brussels Booking fees shall not be refunded in cases of loss or theft, nor shall they be refunded or exchanged except when due to cancellation of the guided tour or event by Explore.Brussels ASBL. Duplicate tickets cannot be issued to replaced lost or stolen tickets.
  8. The customer undertakes to respect the time of the guided tour booked. If the customer does not show up 5 minutes after the start of the booked guided tour, Explore.Brussels The NPO reserves the right to put its ticket back on sale.
  9. Explore.Brussels The non-profit organisation reserves the right to deny access to the guided tour to any person who endangers safety or disrupts the smooth running of the guided tour.
