Terms and conditions applicable to all customers
  1. Unless otherwise expressly agreed and accepted by both parties, only the general and specific terms and conditions attached to this quotation, purchase order, delivery note or invoice shall apply.
  2. All orders are invoiced in accordance with the stated rates. Invoices are payable within fifteen (15) calendar days of the date of issue, unless otherwise stated on the invoice.
  3. Any complaint relating to services provided must, on pain of nullity, be submitted to us in writing (by email or post) within eight days of receipt of the invoice.
  4. In the event of unjustified non-payment of an invoice by its due date, a lump sum of 15 per cent of the invoice amount, subject to a minimum of forty euros, shall be payable to Explore.Brussels ASBL by way of damages, without prior notice.
  5. Failure to pay an invoice by the due date shall render all sums due immediately payable, regardless of any payment facilities previously granted.
  6. The customer acknowledges, in accordance with Article 1583 of the Civil Code, that the goods remain our property until they have been paid for in full, together with any interest and costs. However, the risks are borne by the purchaser from the time of delivery. Eight days after the dispatch, by registered letter, of a formal notice to pay which has remained unheeded, the goods must be returned to us immediately, at the customer’s expense and risk, and the customer hereby undertakes to do so, upon our simple request.
  7. These general terms and conditions are governed by Belgian law and any dispute shall fall within the exclusive jurisdiction of the courts of Brussels. The seller may, however, waive this jurisdiction clause and, if it so prefers, bring proceedings before the court having jurisdiction under ordinary law.
  8. Given the exceptional and temporary nature of the tours and events organised by Explore.Brussels and given that it does not own the premises, Explore.Brussels undertakes to organise what has been contractually agreed to the extent reasonably possible but cannot be held liable in the event of cancellation by the owner of the premises, a last-minute refusal of access to the premises, or the cancellation of the tour or event due to force majeure.

Terms and conditions applicable to business customers
  1. The customer acknowledges that they have been duly informed of the quality, instructions for use and any specific properties of the goods purchased and, unless otherwise agreed in writing by both parties, acknowledges that these goods are not intended for any special purpose.
  2. Any lack of conformity in the supply of goods reported by the customer no later than two weeks after receipt and notified by registered letter shall, at our discretion, result in the repair of the defective item or its replacement. If repair or replacement proves impossible or disproportionate, we shall offer an appropriate price reduction or replacement with goods that are in conformity.

Terms and conditions applicable to visiting customers
  1. The customer undertakes to comply with the rules of the venue visited; any damage may result in a claim for compensation.
  2. The consumer does not have the right to cancel the purchase.
  3. The booking is valid only on the date and at the time specified. Only bookings made via Explore.Brussels ASBL are valid. Any falsification of the booking will result in legal proceedings.
  4. The holder of a booking and any accompanying persons attend the event or tour to which this booking grants access at their own risk and waive any right to take legal action against Explore.Brussels ASBL. Under no circumstances shall Explore.Brussels ASBL be held liable for any material damage or personal injury caused to third parties. The same applies to any theft or loss that may occur before or during the event for which this ticket is issued.
  5. The booking may not be used for advertising and/or commercial purposes without the authorisation of the organisers at Explore.Brussels ASBL. Personal data collected by Explore.Brussels ASBL at the time of sale of this ticket may not subsequently be used for advertising or commercial purposes by third parties. Any request to access, amend or delete this information must be made in writing (by email or post) to Explore.Brussels ASBL.
  6. No right of withdrawal: although Article 47 of the Law on Market Practices and Consumer Protection provides that, for any distance contract, the consumer has a period of 14 days to withdraw from the contract, this right of withdrawal does not apply to contracts concluded via the website. Pursuant to the Royal Decree of 18 November 2002, certain distance contracts for the provision of accommodation, transport, catering and leisure services are excluded from this right under specific conditions. This exception for the tourism sector is dictated by the specific nature of the services provided in this sector and is in line with European regulations on distance selling, which also provide for an exception for accommodation, transport, catering and leisure services.
  7. The booking is non-refundable, even in the event of loss or theft, and cannot be returned, exchanged or amended, except in the event of cancellation by Explore.Brussels ASBL. No duplicate booking confirmation will be issued, even in the event of loss or theft.
  8. The customer undertakes to adhere to the timetable for the guided tour specified in their booking. If the customer does not arrive within 5 minutes of the start of the booked guided tour, Explore.Brussels ASBL reserves the right to put their ticket back on sale.
  9. Explore.Brussels ASBL reserves the right to refuse access to the guided tour to any person who endangers safety or jeopardises the smooth running of the guided tour.
